1. DATA PROTECTION NOTICE
Your privacy is of utmost importance to Kheng Sun Hiring Equipments Pte Ltd (“Kheng Sun”, “we”, “us”, or “our”). This Data Protection Notice (“Notice”) outlines how we manage, collect, use and disclose your personal data in accordance with the Personal Data Protection Act 2012 (“PDPA”).
Also, you agree and consent to Kheng Sun and affiliates as well as our authorised service providers and relevant third parties collecting, using, disclosing and/or sharing your personal data in the manner set forth in this Notice.
This Notice supplements but does not supersede nor replace any other consents which you may have previously provided to us nor does it affect any rights that we may have at law in connection with the collection, use and/or disclosure of your personal data.
We may from time to time update this Notice to ensure that this Notice is consistent with our future developments, industry trends and/or any changes in legal or regulatory requirements. Subject to your rights at law, the prevailing terms of this Notice shall apply.
For the avoidance of doubt, this Notice forms part of the terms and conditions governing your relationship with us and should be read in conjunction with such terms and conditions.
2. DATA WE COLLECT
Depending on your relationship with us (e.g. prospective or current client, employee or business partner), the following Personal Data belonging to you and/ or your organisation, and other individual recipients that we may collect, use, store and disclose include:

2. | Information concerning the products leased and/or purchased, which includes product description, quantity and billing information; | |
3. | Information provided when submitting any reviews or comments regarding our products or services; | |
4. | Financial information, such as bank account numbers that you provide to us when you carry out transactions with us indirectly or in person at our storefront; | |
5. | Relationship information that helps us do business with you, such as the products and services that interest you, your location, your contact preferences, or company name; | |
6. | Photos and videos of you from office surveillances or our events; and | |
7. | Any other information that may be reasonably required to facilitate the leasing, purchase, delivery or service of products to you and/or your organisation, and other individual recipients. |
3. HOW WE MAY COLLECT PERSONAL DATA
Generally, we collect Personal Data that you provide to us or through third parties in ways including the following:
1. | information you submit to us when you use the enquiry form on our website; | |
2. | when you first establish a new client relationship, enter employment or any other business relationship with us; | |
3. | when you rent or purchase equipment and/or other services from us; | |
4. | when you communicate with us via written or verbal forms (e.g. email, telephone), such forms may be recorded and/or retained; | |
5. | when you enter our premises, pictures or videos of you may be captured on our closed-circuit television cameras surveillance | |
6. | when you respond to our requests for additional personal data; or | |
7. | when you submit your personal data to us for any other reason(s). |
We may also, from time to time, contact you by email, over the phone or in person, to request for additional information that is reasonably required to facilitate the leasing/ purchase/ delivery/ service of products to you. In such cases, by providing any Personal Data directly to Kheng Sun, you shall be deemed to have consented to the terms of this Notice, including the purposes set out in this Policy for which Kheng Sun collects, uses, stores and discloses your Personal Data.
4. USES OF YOUR PERSONAL DATA
We may use your Personal Data we collect to:
1. | Performing obligations in the course of or in connection with our provision of the goods and/or services requested by you; | |
2. | Provide you with the website as well as with information, products or services that you request from us; | |
3. | Verify your identity; | |
4. | Responding to, handling, and processing queries, requests, applications, complaints, and feedback from you; | |
5. | Managing your relationship with us including maintaining records of our interactions with you, through documentation (hard copy and electronic); | |
6. | Complete transactions, including your rental or purchase of products and services; | |
7. | Perform our contractual obligations and enforce our contractual rights, including for billing and collection; | |
8. | Evaluate and improve our products and services, and / or develop new products or services; and | |
9. | other purposes, directly or indirectly relating to any of the above and our business activities. |
(hereinafter collectively referred to as the “Purposes”).
If we wish to collect, use, store and/or disclose your personal data for any other purposes, we will adequately seek your consent.
5. DISCLOSURE OF YOUR PERSONAL DATA
We may disclose your Personal Data:
1. | Where such disclosure is required for performing obligations in the course of or in connection with our provision of the goods or services requested by you; or | |
2. | To third party service providers, agents and other organisations we have engaged to perform any of the functions listed in the preceding section. |
The purposes listed in the above clauses may continue to apply even in situations where your relationship with us (for example, pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).
6. RETENTION OF PERSONAL DATA
We may retain your personal data for as long as it is necessary to fulfil the Purposes for which it was collected, or as required or permitted by applicable laws.
We will cease to retain your personal data, or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the personal data was collected, and is no longer necessary for legal or business purposes.
7. ACCESS TO AND CORRECTION OF PERSONAL DATA
You are responsible for ensuring that the Personal Data you provide to us is accurate, complete, and not misleading and that such Personal Data is kept up to date. You acknowledge that failure on your part to do so may result in our inability to provide you with the products and services you have requested.
If you wish to make
1. | an access request for access to a copy of the personal data which we hold about you or information about the ways in which we use or disclose your personal data, or | |
2. | a correction request to correct or update any of your personal data which we hold about you, |
you may submit your request in writing or via email to our Data Protection Office (“DPO”) at the contact details provided below.
If you provide personal information of any third party to us, we assume that you have obtained the required consent from the relevant third party to share and transfer his/her personal information to us.
We will respond to your request as soon as reasonably possible. Should we not be able to respond to your request within 30 days after receiving your request, we will inform you in writing within 30 days of the time by which we will be able to respond to your request. If we are unable to provide you with any personal data or to make a correction requested by you, we shall generally inform you of the reasons why we are unable to do so (except where we are not required to do so under the PDPA).
8. WITHDRAWING YOUR CONSENT
We will respond to your request as soon as reasonably possible. Should we not be able to respond to your request within 30 days after receiving your request, we will inform you in writing within 30 days of the time by which we will be able to respond to your request. If we are unable to provide you with any personal data or to make a correction requested by you, we shall generally inform you of the reasons why we are unable to do so (except where we are not required to do so under the PDPA).
Upon receipt of your written request to withdraw your consent, we may require reasonable time (depending on the complexity of the request and its impact on our relationship with you) for your request to be processed and for us to notify you of the consequences of us acceding to the same, including any legal consequences which may affect your rights and liabilities to us. In general, we shall seek to process your request within ten (10) business days of receiving it.
Whilst we respect your decision to withdraw your consent, please note that depending on the nature and scope of your request, we may not be in a position to continue providing our goods or services to you and we shall, in such circumstances, notify you before completing the processing of your request. Should you decide to cancel your withdrawal of consent, please inform us in writing in the manner described in the first paragraph of this section.
Please note that withdrawing consent does not affect our right to continue to collect, use and disclose personal data where such collection, use and disclose without consent is permitted or required under applicable laws.
9. PROTECTION OF YOUR PERSONAL DATA
At Kheng Sun, we take all reasonable steps to protect your Personal Data against unauthorized disclosure. We do not disclose your Personal Data to third parties except when required by law or to the following for the same Purposes listed in Section 4:
1. | Our subsidiaries, affiliates and employees to provide and fulfil our services and obligations to you; | |
2. | Our agents, contractors or third-party service providers who provide operational services and support so as to assist in the fulfilment and performance of our services and obligations to you; | |
3. | Our consultants and professional advisors, such as lawyers, auditors and bookkeepers; | |
4. | Relevant regulatory bodies, statutory boards or law enforcement agencies in compliance with applicable law; and | |
5. | Any other party to whom you have provided your consent for such disclosure. |
In the event your Personal Data is disclosed to third parties as per the above, Kheng Sun will ensure that these third parties conform to this Policy, the Personal Data and confidentiality requirements.
In addition, Kheng Sun implements strict standards of security across our operations to prevent any leakage, loss, damage, or unauthorized copying of your Personal Data in our systems.
You should be aware, however, that no method of transmission over the Internet or method of electronic storage is completely secure. While security cannot be guaranteed, we strive to protect the security of your information and are constantly reviewing and enhancing our information security measures. As a result, Kheng Sun cannot ensure or warrant the security of any information transmitted to the site over the Internet.
10. GOVERNING LAW
The laws of Singapore govern Kheng Sun’s Personal Data Protection Policy and any dispute relating to this Policy shall be submitted to the exclusive jurisdiction of the courts of Singapore.

12. UPDATES TO THIS DATA PROTECTION NOTICE
Kheng Sun reserves the right to amend this Notice from time to time, in accordance with the prevailing law. The amended Notice shall at all times be available on our website. If you have registered for any of products or services or have an account with us, we may also inform you through a communications channel that you have provided. The date the Notice was last revised is identified at the bottom of the page. Any changes to this Notice will become effective upon posting of the revised Policy on the site. Your continued use of our services constitutes your acknowledgement and acceptance of such changes.
